    What It Means

    For Agencies

    Statutory Landscape

Most States Leave Laterals to Local Rules

Six jurisdictions have state law that assigns lateral responsibility or allows public repair funds. Everywhere else, authority sits in local code or a utility rule.

    Point of Sale

No State Requires an Inspection at Sale

Point-of-sale ordinances are local. The East Bay region of California, Twin Cities suburbs such as Golden Valley, and Pennsylvania towns such as Upper St. Clair are the clearest examples.

    Funding Drivers

Enforcement and Regional Rules Drive Programs

Consent decrees drove the East Bay and St. Louis programs. In Minnesota, the regional I&I surcharge did. Look for both before you design a program.
